How Should My Firm Check an Unexpected Trademark Renewal Invoice?

Prepare a focused review note for an unexpected trademark invoice, with the request, independent evidence, unresolved differences and an authorized decision-maker.

Hold the unexpected request for verification before routing it as an approved payment. The USPTO scam guidance warns that misleading demands can use real trademark details. It directs readers to TSDR's Documents tab for official correspondence and to verified agency contacts when authenticity is uncertain. A familiar mark or registration reference is not enough by itself.

Separate the source of the demand from the service being offered. An optional private service charge and an official government fee are different items. The assistant's useful output is a discrepancy note for the attorney and authorized payer, not an independent decision that a vendor committed fraud or that no payment can ever be due.

What education and practical skills should I assess?

For a Trademark virtual legal assistant, assess relevant legal, paralegal or business-administration education and the person's ability to compare records carefully. Ask them to explain the difference between a supplied statement, an independently checked source and a decision still awaiting review. Verify individual education and experience; an overseas degree does not itself establish U.S. licensure.

Use our education and credentials overview as a starting point, then test the proposed person's actual work with a fictional example. The exercise below focuses on comparison and clear writing.

How should the comparison start?

The FTC trademark warning recommends independent official links and contact details instead of links or QR codes supplied in an unexpected demand.

Use the firm's approved security process for the incoming message. Record the claimed service, amount, reference and requested action without interacting with its payment instructions. Open the known official source separately and retain the observation date with the record being compared.

Read the request's fine print as part of the comparison. Is it presenting itself as an agency demand, or offering a private service? If the evidence does not establish that it is official correspondence, use “not verified as official” and explain what remains unresolved. Have the attorney decide the legal obligation and next response.

What belongs in the attorney's review note?

The following is a proposed internal note. Keep the original request and comparison evidence in the firm's approved system, with access limited to the assigned team.

ItemWhat the assistant records
Incoming requestWhat the sender asks the recipient to buy, pay or do.
Independent evidenceThe official record checked, observation date and relevant document reference.
Unresolved differenceA mismatch or missing corroboration, without replacing it with a fraud verdict.
Existing instructionAny current firm-approved instruction for the matter, kept distinct from the demand.
Decision ownerThe reviewing attorney, authorized payer and next internal review step.

A Trademark remote legal assistant can prepare that factual comparison within the assigned scope. Keep the firm's existing attorney-approved docket entry unchanged while the new demand is being reviewed. If instructions conflict, show both to the attorney rather than selecting a renewal date independently.

What would a useful fictional exercise look like?

Create a made-up mark, Sample Harbor, and two clearly fictional documents: an invoice offering a private listing service and an internal matter instruction that says no purchase has been approved. Supply a separate sample official-record excerpt. Do not use a real registration, client name or account.

Ask the applicant to identify what each document actually establishes, write the unresolved questions and name the decision still needed. Look for someone who can preserve the difference between “a service is offered” and “our firm approved buying it.” This proposed exercise is not a client incident or proof of a candidate's qualifications.

How can my firm scope this support?

For Trademark paralegal outsourcing, define a narrow assignment: collect the existing evidence, prepare the comparison and route it to a named reviewer. Specify who controls client communications and payment authorization. Keep legal deadline calculations, rights advice, filing decisions and substantive responses with the attorney.

Our trademark support service provides a place to discuss that administrative scope. At remotelegalteam.com, match the proposed person's education and work sample to the review process your firm actually uses. This is operational information, not legal advice.

Frequently asked questions

Can the assistant approve payment after preparing the note?

Only the firm's authorized payer can approve payment under its process. Completing a comparison does not supply that authority or replace the attorney's review.

Should the incoming invoice replace the firm's docket date?

Keep the existing approved entry and refer the new request to the attorney. Record any later change only with the attorney's actual instruction and supporting reference.

What if the client has already forwarded the request to accounting?

Give the assigned reviewer the current routing status and unresolved questions. Ask for a coordinated decision so accounting and the matter team act from the same approved instruction.
